基层派出所视频侦查体系构建实证研究

视频侦查已成为公安机关重要的刑侦基础性工作。目前省、市、县、所四级公安视频侦查体系基本建成,而作为基层一线的“所级”视频侦查体系,实践中没有受到足够的重视。应强化派出所层级的视频侦查体系建设,同时,合理协调全社会视频监控系统建设的系统推进,以提升视频侦查工作实战效能。     

Forensic Application of Analytical Mechanics in Fatal Fall From a Height

Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios.     

Terrorist violence and the enrollment of psychology in predicting Muslim extremism: critical terrorism studies meets critical algorithm studies

Discourse on terrorist violence has long facilitated an especially liberal form of securitisation. Originally evoked in reference to anarchists and communists, a rational consideration of terrorist violence, inaugurated by the concept, asks for deferred judgement about the nature of, or reasons behind, violence related to terror on the premise that state and international legal norms governing the legitimate use of violence fail to circumscribe the proper capacities of the state to regulate and explain terrorism. Where sovereign powers along with their military and civilian instruments of coercion are deemed unable to regulate violence effectively, analysts of terrorist violence and their readership are invited to consider and cultivate new sensibilities. Beginning in the 1980s, studies by psychologists found renewed urgency among a growing cadre of interdisciplinary terror experts who found religion, Islam especially, a key variable of analysis. I situate their contributions in a longer history of secular and racialising discourse about terrorist violence. Central to this history are practices of reading, translating, interpreting and archiving texts. Evidence for the argument is based on the analysis of an algorithm that allegedly predicts the likelihood of terrorist strikes by counting words spoken by al-Qa?ida leaders and correlating their frequency with over 30 psychological categories.     

网络信息安全犯罪的定量评价困境和突围路径——大数据背景下网络信息量化标准的反思和重构

刑法对网络安全的保护立场，正由网络运行安全转向网络信息安全。刑事立法更新不断增设网络信息安全专属罪名的同时，刑事司法的定量评价体系却未能一体构建，成为网络安全刑法保护的薄弱环节。当前网络信息安全犯罪的定量评价体系缺乏明确的逻辑主线，同时适用错位的“传统法益侵害程度”量化标准和模糊的“数据规模”新型量化标准，无法满足网络信息安全专属罪名司法适用的准确性和统一性需求，导致了司法适用的困境。消弭规范和技术之间的差异，以“信息规模”为定量评价核心的基础上，建构信息价值的分层评价模型，并将“组信息”作为基础的数据规模计量单位，是大数据时代背景下，突破网络信息安全犯罪司法定量评价困境的合理路径。     

"堰塞湖"型社区治安管理模式探析 ——以北京市崔各庄东辛店村为例

基层治,则天下安。在新型城镇化纵深推进大背景下,对流动人口住处的疏解整治成为解决"大城市病"的必要手段,但实践中拆迁整治引发了"堰塞湖效应","堰塞湖效应"使得流动人口流入地社区演变成"堰塞湖"型社区。对此类社区的治安管理应革新以往防范式治安管理模式,有针对性地构建社区治安问题"审视→分析→反应→评估"的治安管理模式,根据"堰塞湖"型社区治安问题产生的原因及管理困境,形成一套从宏观到微观的逻辑严谨、运行有序的治安管理体系。具体可从树立"善治"和"共治"治安管理理念、促进流动人口社区融合和社区治安资源整合等方面入手解决"堰塞湖"型社区治安问题,以维护社区安全稳定。     

商标侵权惩罚性赔偿的制度构建

我国《商标法》2013年第三次修改时首次在知识产权领域引入惩罚性赔偿责任。实证分析表明,惩罚性赔偿在商标侵权诉讼中适用甚少且适用不规范的问题突出,未能充分发挥其遏制侵权行为的预期作用。究其原因,主要存在适用条件不明确、赔偿基数难确定、程序保障不充分等问题。为规范适用,充分发挥惩罚性赔偿的作用,需要从以下四个方面完善其制度构建:一是强化程序保障;二是明确适用条件;三是完善赔偿数额的计算;四是厘清惩罚性赔偿与法定赔偿的关系。     

南北沙参差异及使用建议

南沙参用药历史比北沙参早2 600多年；南沙参资源储备比北沙参丰富，分布也较广；南沙参功效较多，且其主治增加幅度多于北沙参。建议《中华人民共和国药典》收载沙参、杏叶沙参和无柄沙参为中药南沙参的原植物，扩大南沙参药原；建议有关部门做好北沙参野生种资源保护，建立珊瑚菜种质资源库；建议临床医生在选清肺热、养肺阴中药时，以南沙参为主，辅以北沙参。     

From discourse to policy: US policy communities’ perceptions of and approaches to climate change and security

ABSTRACT

Increasingly, a diverse set of policy communities, including those with defence, development and environmental mandates, frame climate change as a security threat. Most often this discursive formation labels climate change as a ‘threat multiplier’. This framing, however, is vague, linear and leaves many questions unanswered regarding how institutions can develop and implement policy that addresses the joint challenges of climate change, conflict and security. Utilising a mixed-methods approach, and grounding data collection in US policy communities, this article examines how policy actors and institutions integrate climate-security discourses into policy processes. The objective of this research is to provide direct insight into how the discourses and technical understandings of climate-security transition into policy priorities and implementation realities. This research identified three common approaches to climate-security: (1) A challenge of adaptation and resilience; (2) A potent political argument; and (3) An issue of limited importance and feasibility. These approaches, however, are inconsistent across sectors and within organisations, suggesting a lack of cohesion and considerable challenges in identifying and responding to climate change as a ‘threat multiplier’.     

Gaughran vs the UK and public acceptability of forensic biometrics retention

This commentary provides a response to the European Court of Human Rights ruling in the case of Gaughran vs the United Kingdom on 13 February 2020. The Court ruled that the indefinite retention of DNA, fingerprints and facial images from all convicted adults was disproportionate. Using data from a survey on public attitudes, we examine the public acceptability of the police retention of forensic biometrics from the population.
